Mori Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and Mori ("Mori", "we", "us", or "our") governing your access to and use of the Mori mobile application and related services (collectively, the "Service"), a community platform for sharing and following diary-style stories about stray and community animals. By creating an account, tapping to agree, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not access or use the Service. If you are accessing the Service on behalf of another person, you represent that you are authorized to accept these Terms on their behalf.
• The Service is intended solely for individuals who are 18 years of age or older. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms in your jurisdiction of residence.
• We do not knowingly allow individuals under the age of 18 to register for or use the Service. If we become aware, through automated detection, user reports, or otherwise, that an account belongs to a person under 18, we will suspend or terminate the account and remove associated content without prior notice.
• You further represent that you are not barred from using the Service under the laws of your jurisdiction, and that you are not listed on any government sanctions or export-control denial list.
• Mori reserves the right to request proof of age or identity at any time to verify eligibility, and to suspend accounts pending such verification.
• To use most features of the Service, you must create an account using Sign in with Apple. You agree to provide accurate information and to keep your account credentials confidential.
• You are solely responsible for all activity that occurs under your account, whether or not authorized by you, except to the extent caused by our own gross negligence or willful misconduct.
• You must notify us immediately at service@mori.love if you become aware of any unauthorized use of your account or any other breach of security.
• You may not transfer, sell, rent, or share your account with any other person, and you may not create an account on behalf of anyone other than yourself.
• We reserve the right to refuse registration, suspend, or terminate any account at our discretion, including where we suspect fraudulent, abusive, or otherwise harmful activity.
• Mori allows users to create profiles for stray or community animals they care for, and to publish diary-style entries combining text, photographs, and voice recordings documenting those animals' stories.
• Users may browse a For You feed of recommended stories, follow specific animal profiles and their Following feed, like, comment on, and save diary entries, and communicate with other users through one-to-one messaging.
• Mori offers a virtual coin system used to unlock additional animal profile slots and to generate exportable Memory Books compiling an animal's diary history, as further described in Section 9.
• We may add, modify, suspend, or discontinue any feature of the Service, in whole or in part, at any time, with or without notice, and without liability to you.
• Subject to your compliance with these Terms, Mori grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the application on a device you own or control, solely for your personal, non-commercial use.
• You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works based on the Service, except to the extent such restriction is prohibited by applicable law.
• You may not use any automated system, including bots, scrapers, or crawlers, to access the Service for any purpose without our prior written consent.
• All rights not expressly granted to you under these Terms are reserved by Mori and its licensors.
• You agree not to post, upload, or transmit any content that is unlawful, defamatory, obscene, harassing, threatening, hateful, or that depicts animal cruelty, abuse, or graphic violence toward any living creature.
• You agree not to impersonate any person or entity, misrepresent your affiliation with any person or entity, or provide false information about an animal profile, its condition, or its location.
• You agree not to use the Service to solicit money, donations, or goods outside of the Service's supported virtual currency features, or to engage in any fraudulent fundraising scheme related to animal care.
• You agree not to harass, stalk, threaten, or send unwanted communications to other users, and not to use the one-to-one messaging feature to send spam, unsolicited advertising, or malicious links.
• You agree not to attempt to gain unauthorized access to any part of the Service, other user accounts, or our systems and networks, or to interfere with the proper functioning of the Service, including through the introduction of viruses or malicious code.
• Violation of this Section may result in content removal, temporary suspension, or permanent termination of your account, at our sole discretion, without refund of any purchased virtual currency.
6.1 Ownership and License Grant
• You retain all ownership rights in the text, photographs, voice recordings, and other content you submit to the Service ("User Content"). By posting User Content, you grant Mori a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, and create backup copies of your User Content solely for the purpose of operating, promoting, and improving the Service.
6.2 Content Standards
• You represent and warrant that you own or have obtained all necessary rights and permissions to post your User Content, and that your User Content does not infringe the intellectual property, privacy, or other rights of any third party.
• You are solely responsible for your User Content and the consequences of posting it. Mori does not endorse and is not responsible for the accuracy, reliability, or content of any User Content posted by other users.
6.3 Copyright and Removal
• If you believe that content on the Service infringes your copyright, please submit a notice to service@mori.love with sufficient detail to identify the material and your rights. We will review and, where appropriate, remove infringing content and may terminate accounts of repeat infringers.
• Mori reserves the right, but has no obligation, to review, screen, remove, or restrict access to any User Content at any time and for any reason, including content that violates these Terms or our community guidelines, without prior notice to the poster.
• The Service is strictly limited to adults aged 18 and over, and is not directed to, and must not be used by, children.
• Mori maintains a zero-tolerance policy toward any content, communication, or conduct constituting Child Sexual Abuse and Exploitation (CSAE), including any material that sexualizes, endangers, grooms, or otherwise exploits a minor. Any such content or conduct is strictly prohibited under these Terms.
• You agree to immediately report any suspected CSAE content or behavior encountered on the Service using the in-app Report function or by emailing service@mori.love. We treat all such reports as highest priority.
• Accounts found to be involved in CSAE violations will be permanently terminated without notice, and we will preserve relevant evidence and disclose it to the National Center for Missing and Exploited Children (NCMEC) or other competent law enforcement or child-protection authorities as required or permitted by applicable law.
• Mori reserves the right to use automated detection tools in combination with human review to identify and act upon suspected CSAE material across all content types supported by the Service, including images, text, and voice recordings.
• The Service provides in-app tools allowing you to report diary posts, comments, animal profiles, user accounts, and private messages that you believe violate these Terms or applicable law.
• You may block another user at any time, which will prevent that user from viewing your content, following your profiles, or sending you private messages.
• We aim to review and act upon valid reports within twenty-four hours of submission, though response times may vary depending on complexity and volume.
• Mori's moderation decisions, including content removal and account suspension or termination, are made at our sole discretion, and we are under no obligation to provide detailed reasoning for any specific moderation action, except as required by applicable law.
9.1 Coins
• Mori offers an in-app virtual currency ("Coins") that may be purchased through Apple's In-App Purchase system in various package denominations, and used to unlock additional animal profile slots and to generate Memory Book exports, each priced in Coins as displayed within the app prior to purchase.
• Coins have no monetary value, are not redeemable for cash, cannot be transferred between accounts, and are solely a limited, revocable license to access certain digital features of the Service.
9.2 Purchases
• All purchases of Coins are processed by Apple and are subject to Apple's own payment terms and conditions. You must have a valid Apple ID and payment method on file with Apple to complete a purchase.
• Prices for Coin packages are displayed in the app prior to purchase and are subject to change at our discretion; changes will not affect purchases already completed.
9.3 Refunds and Disputes
• Because Coins are Consumable in-app purchases processed through Apple, all refund requests must be submitted directly to Apple through its standard refund request process. Mori does not directly process refunds for completed purchases.
• Except as required by applicable consumer protection law, all Coin purchases are final and non-refundable once the corresponding feature has been unlocked or the Memory Book has been generated.
• If you believe a Coin transaction was processed in error, contact service@mori.love with your purchase details, and we will investigate and assist where appropriate, without guaranteeing any specific outcome.
• The Service, including its software, design, graphics, logos, trademarks, and all content not submitted by users, is owned by Mori or its licensors and is protected by copyright, trademark, and other intellectual property laws.
• You may not use Mori's name, logo, or trademarks without our prior written consent, except as necessary to accurately describe your use of the Service.
• Nothing in these Terms transfers any ownership rights in the Service or its underlying technology to you.
• The Service integrates with certain third-party services, including Sign in with Apple and Apple's In-App Purchase system, which are governed by their own respective terms and privacy policies.
• Mori is not responsible for the availability, accuracy, or practices of any third-party service, and your use of such services is at your own risk and subject to the applicable third party's terms.
• Our collection, use, and disclosure of information in connection with the Service is governed by our Privacy Policy, available within the app and at our website, which is incorporated into these Terms by reference.
• By using the Service, you consent to the data practices described in the Privacy Policy, including the limited camera and microphone permissions used to support diary photo and voice recording features.
• These Terms remain in effect for as long as you use the Service. You may stop using the Service and delete your account at any time through Settings > Delete Account.
• We may suspend or terminate your account or access to the Service, in whole or in part, at any time and without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or harmful conduct, or if required to comply with applicable law.
• Upon termination, your right to use the Service will immediately cease, and we may delete your account data in accordance with our Privacy Policy, except for information we are required to retain for legal, safety, or fraud-prevention purposes.
• Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and any other provisions that by their nature should survive termination will remain in effect after termination of your account.
• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
• Mori does not warrant that the Service will be uninterrupted, error-free, or secure, or that any content, including User Content, is accurate, complete, or reliable.
• Mori is a platform for user-generated storytelling and does not independently verify the condition, ownership, or welfare status of any animal referenced in User Content, and does not act as an animal rescue, veterinary, or fundraising organization.
• Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you, in which case such warranties are limited to the minimum scope and duration permitted by applicable law.
• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MORI AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MORI'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO MORI FOR COINS IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TWENTY UNITED STATES DOLLARS.
• Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you, in which case Mori's liability will be limited to the fullest extent permitted by applicable law.
• You agree to indemnify, defend, and hold harmless Mori and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
• Mori reserves the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims.
• Most concerns can be resolved quickly by contacting us at service@mori.love, and we encourage you to reach out to us before pursuing formal dispute resolution.
• Except where prohibited by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual action in small claims court.
• YOU AND MORI EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING, TO THE EXTENT PERMITTED BY APPLICABLE LAW.
• If any part of this arbitration provision is found to be unenforceable, the remainder of this Section will remain in force, and the unenforceable portion will be severed.
• Users in jurisdictions where pre-dispute arbitration agreements are not enforceable, including certain consumer protection contexts, retain the right to bring claims before a competent court in accordance with applicable local law.
• These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles, except to the extent that mandatory consumer protection laws of your country or state of residence provide otherwise.
• If you are a consumer residing in the European Union, United Kingdom, or another jurisdiction that grants you mandatory local consumer protections, nothing in this Section deprives you of the protection of those mandatory provisions.
• We may modify these Terms from time to time to reflect changes in our Service, legal requirements, or business practices.
• Material changes will be communicated through an in-app notice, a pop-up prompt, or another reasonable method prior to the changes taking effect, where required by applicable law.
• Your continued use of the Service after any updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.
• You represent that you are not located in a country subject to a United States government embargo, and that you are not listed on any United States government list of prohibited or restricted parties.
• You agree to comply with all applicable export control and economic sanctions laws and regulations in connection with your use of the Service.
• If any provision of these Terms is found to be invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• Mori's failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
• These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and Mori regarding your use of the Service, and supersede any prior agreements between you and Mori relating to the Service.
• You may not assign or transfer these Terms, by operation of law or otherwise, without Mori's prior written consent. Any attempted assignment in violation of this Section will be null and void.
• Mori may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
